The research project on Taiwan’s Coast Guard Act

Taiwan is facing an increasingly dynamic and complex maritime environment. Disputes over surrounding waters and the rise of illegal maritime activities have become more frequent, with “gray zone” operations occurring regularly. These developments pose significant challenges to Taiwan’s maritime law enforcement and national security. In light of the evolving regional landscape and the growing severity of non-traditional security threats, it has become essential to strengthen and clarify the missions and enforcement authorities of the Coast Guard Administration, Ocean Affairs Council (CGA, OAC). As the frontline agency for maritime law enforcement, the CGA must be empowered to effectively respond to emerging operational demands and enforcement challenges.
The current Coast Guard Act still leaves room for improvement, both in its legislative framework and in practical implementation. To enable the CGA to fully perform its intended functions, this project undertakes a comprehensive review of the existing Act—examining its overall structure as well as its substantive provisions—and proposes research-based recommendations and draft amendments. These proposed revisions are intended to serve as valuable references for the OAC in future legislative references.
